KUALA LUMPUR, Jan 6- Petaling Jaya Utara Member of Parliament Tony Pua said today that PLUS, the concession holder for the North-South Expressway stands to make a staggering RM25 billion in profits, in the next 20-years.
Pua, who spoke to reporters after scrutinising declassified toll concession agreements at the Works Ministry here, said PLUS made a profit of RM1.2 billion last year and the amount will increase annually till the concession ends, in 2038.
"Under the agreement the concessionaire has all to gain and nearly nothing to lose."
Pua, who was at the Works Ministry, with Serdang MP Teo Nie Ching and Kampung Tungku Assemblyman Lau Weng San, said PLUS is also exempted from paying taxes on its profits.
As such, he said DAP was justified in objecting to the privatisation of PLUS to United Engineers Malaysia (UEM) in 1988.
"It was a hot issue, which was used as one of the justifications by the Government to detained 16 DAP national leaders, including Lim Kit Siang and Karpal Singh, under the ISA, during Operation Lalang."
Teo, who got a first look at the concession agreement this morning describe it as a 'profit guaranteed' contract, which favours the concessionaire.
Under the agreement, the company can impose higher toll charges if traffic volume is less than what is projected, while the government will have to provide compensation if it objects.
She said the original 30-year-concession, signed in 1988, had already been extended further by 20-years, as a form of compensation.
Teo said terms in a supplementary agreement, signed in 1999, made it virtually impossible for the government take over the concession.
"Besides having to pay the cost of construction, which was just RM5.94 billion, and any outstanding loans owed by the company, the Government would be forced to pay an amount equal to future profits."
Teo questioned the Government's rationale in entering into the agreement in the first place.
"Why privatize the highway, when they could have built it and run it themselves."
Meanwhile Pua also dismissed assertions by Works Minister Datuk Mohd Zin Mohamed yesterday that buying back some of the concessions, such as Lebuhraya Damansara-Puchong (LDP), would be too expensive.
He said the LDP was constructed at a cost of only RM1.327 billion but to date the company had received RM630 million in compensation for not raising toll charges and would continue to receive RM75 million annually.
"The numbers are stark and it is obvious that it would be better for the Government to buy back the concession rather than continuing to pay compensation."

As far from my point of view regarding toll collectors, the government should allow them to increase their toll charges when requested instead of paying them off compensation. Think again, IF we use all the compensation monies to build connecting routes around toll areas and better roads around the area to relief traffic. Then the people has a choice to choose whether to pay the toll or use alternative routes.
Example; there is no "non toll" roads leading to PUCHONG from Shah alam, Sunway or from putrajaya, If we can just add a few road from sunway to puchong, shah alam to puchong, and putrajaya to puchong then definately the amount of compensation monies used to paid the toll could afford to do all such.
point is:
1. Allow toll concessionaries to increase their toll as per their wants.
2. DO NOT pay compensations to highway concessionaries
3. USE the suppose to be compensation to build more connecting roads around the area
4. USE the suppose to be compensation to improve the public transport system e.g. LRT or rail services connecting to other places.
5. DO NOT extend their contract

This is a sucking contract, anybody can be successful in these type of business. May the whole world only our govt has these type of contract, surely concessionaire can make tons of profit by these type deals.
Business losses are guarantee buy the govt and even compensate them. The people voted form are betrayed by such a deals. The public have to pay a high price for deals done by our govt.
Need justice and investigation in such type of agreements. No thank to those decision makers at that time.

Something is seriously not right with the UMNO govt, especially the previous govt under Mahatir that we have come to such a situation.

1. Only profiting certain parties and detrimental to the people of Malaysia ( not the current government who claim to represent the people). Whether the profits were reasonable or exorbitant.
2. Whether set conditions to protect only the concessionaires and which is unfair to the people of Malaysia and that cannot be challenged or only terminated with exorbitant compensations is a valid agreement that cannot be challenged in a court of law.
3. Whether through an Act of Parliament, the government can nationalise the highways without paying these concessionaires exorbitant compensation, but only a reasonable compensation to settle the cost of the projects.
4. Whether action can be taken on government servants and legal officers who vetted these agreements or were signatories to these agreements when they knew it was not beneficial to the people of Malaysia. It does not matter whether they did it due to political pressure as they should still have done the right thing.

Maybe someone is right here that let the concessionaires raise the toll rate so as our government need not to pay our "rakyat" money as compensation to them. Don't use the highway if you think the rate is high. There is always a federal roads. So let the concessionaires go bankrupt then nobody collect toll for us. Hmm, if they is no more concessionaires, where is all the employees go? Retrenchment? Or our government can convert them to civil servants? Wow...if like that where the government wants to get all these money to pay them and how about the cost for maintenance works since there is no collection of toll? Maybe they can raise our income tax?Or borrow from the World Bank, IMF, etc.? Ooh my...please get me a real professional body to look into this...

Consider this, someone broke into your house, you report to the police? what would they do? they will just key in the report. that's it. Consider this too, your wife, your sister, your mother, or your daughter is being rapped by some anak of Tun, you report to the police. Do you think they are able to solve your case? So think using your head. Unless you yourself is anak of Tun or yourself a Tun.
You are half learner. You just don't know to use your god given brain and can't see the big picture. Have you been outside Malaysia lately? Do you know the highway in Thailand is free after the concession is over. Do you know the highway in the US is free, and if they charge it in some states it cost only 15 cents or maybe 50 cents for hundreds of miles. Do you know a mile is not a kilometer?
Maybe you don't know how the economy works. Actually if you are so slothful you could google or wikipedia to find some of the information you need. Let me give you a simple idea, I hope you can comprehend since you are very dim-witted. If the cost of doing business is so cheap, cheap transportations, cheap tolls, cheap labors, we can attract foreign investors as well as domestic investors to do business here in Malaysia. (provided we fix our judiciary system first)
Do you know in today's world volume is everything, competition is very high among countries, every country try to be very competitive. Every country wants to be like China, cheap labor, good infrastructure, huge market, everything is very cheap there in China. That's why so many investors invest there. They want to be competitive to compete globally.
So if our country wants to be competitive we should provide the environment for it to happen. We also need to encourage people to improve themselves. We actually already have a good infrastructure, too bad it is just too costly. Our fuel is expensive (we are the net exporter), our toll is expensive, our enforcement cannot be trusted, our judiciary system cannot be relied on and so many uncompetitive features that drives away foreign and local investors.
Government is no brainer in thinking of making collecting revenue from oil, tolls, and other thing. They should think on how to expand the economy. They should think how to make us compete globally, not just locally. Government should think big. Government should be led by educated and professional, not by someone with unrecognized degree, not by graduate from unknown universities, not by someone who not even finished his degree after returning back from Europe for his father funeral in 1970s, not by someone who is video tapped having sex with other than his spouse.
We need qualified and credentials person. Person who can bring us forward, compete with Singapore or Taiwan not Zimbabwe. Come on bro. Think!

Seriously, I believe we have to look at the bigger picture. Do u think the chinese or indian hates malay? No. We don't hate their leaders.
The problem is corruption. Funds are not being used properly. Perhaps it's right to say "PLUS still have to loans to service". It's a crap for anyone to defend this. It's only common for a company to service loans. How do u build highway without money. Then may I ask, if the company had to take up loan to build the highway, why didn't our G build it in the first place?
And them some idiot mentioned "LET's BOYCOTT THE TOLL". A real crap. Anyone that uses the Federal Road will know... how bad the traffic jam is.
We have not improved our public transportation. Our councils Urban Planning is bloody poor.
Why all these happens? You have to ask yourself about that.
To me... whether DSAI will be a better leader or not, I really don't know. But for one I know, we might as well change to see whether it can make a difference. Electing a leader is about making a difference. If a leader can't lead, then like DIGI's motto "IT's TIME TO CHANGE".

If our taxes already more than covers construction cost, then UMNO is only appointing their cronies to extort money from the public. And everyone of all races is a victim.
Even the Malays should not be so dumb to pay for the luxuries of only a few selected elites, by continuing to vote for UMNO. Forget about job creation arguments, a government run highway also provide the same number of jobs for bumiputras.
How can a nation advance in economic status if it is run by corrupt greedy individuals. After the oil is gone, I bet you UMNO will evolved into a fundamentalist extremist group to stay in power. Then it will no longer talk of progress but only about protecting their race, their religion because the economy is dead so they will tell you it good to be poor.

Talking about stupid agreements entered into by out beloved 'Bapa Pembangunan', why are we all so surprised? We should be well aware of the fact that we engaged a construction company to build a bridge to Singapore without getting the agreement of Singapore Government, and see what has happened to the structure now? (I really hope it i will be declared someday as one of the few new additions to the world wonders, at least then we can attract the tourist here to see this great white elephant and get some money which we have compensated the construction company for building it. Any takers to guess who were the ones behind the said construction company?)
What about the agreement which we entered to sell raw water to Singapore at dirt cheap price? and extended over and over again? Hmmmn, i will have to say that that was indeed a wonderful deal entered into as far as Singapore is concerned. I makes me wonder how can Singapore, being a small country manage to get wise people to advise them on the deals and yet Malaysia who boast to have all the resources, can't?
Talking about blood sucking, what I read on news paper this morning about one Minister saying that the Government would need to raise the petrol price again if crude oil price increases to 50USD. Isn't the Government already making so much profit even if it is maintained at RM1.80? What has happened to our government? Coffers running dry? I thought our country's fundamentals are very strong and we can face this economy meltdown without much issues? What about giving RM3.6m to Palestine? From where is this money coming?
As for the PR, yes I am sure you are taking all efforts to make sure there is transparency. But, at the same time you will need to make sure you are prepared to be a good government. As of now, you have 4 states which you are at helm. Make the best out of this opportunity and prepare yourself to be a strong and efficient Government when you are called upon by the rakyat and be assured that if you are gonna spend all the time digging rubbish and not doing something concrete, you are not doing much good to the country.
