IPOH, March 3 — The High Court here has declared as illegal this morning’s emergency sitting of the Perak state assembly which was held on a street under a tree.
The court granted the order restraining Speaker V Sivakumar from convening meetings “purporting to be meetings of the Perak legislative assembly” after accepting arguments that the immunity from judicial review stated in the federal constitution was only for proceedings in the state assembly.
After listening in chambers to lawyers representing Perak Menteri Besar Datuk Zambry Abd Kadir and his executive council and the assistant state legal advisor Zulkarnain Hassan for two hours, Judicial Commissioner Ridwan Ibrahim granted the order at 5pm under Section 44 of the Specific Relief Act which grants the court the power to make orders to a public official.
The order is for an indefinite period of time.
When asked by reporters, Zambry’s lead counsel Firoz Hussein Ahmad Jamaluddin said that the issue of a time did not arise as the speaker had no power to call for a sitting of the assembly as only the Sultan was authorised to do so under Article 36(1) of the Perak Constitution.
“There was no royal consent, so the meeting under the tree, remains just a meeting under the tree,” added Datuk Hafarizam Harun, Umno’s legal advisor, who is also part of the executive council’s legal team.
Earlier today Perak Speaker V Sivakumar convened an emergency sitting of the state assembly which effectively voted to end Zambry’s de facto Barisan Nasional (BN) government.
The court’s declaration was the latest development on an eventful day in which Perak’s administration was thrown into chaos with both BN and Pakatan Rakyat (PR) questioning the legitimacy of each other’s actions.
The State Secretary had earlier directed the closure of the building which houses the state assembly venue.
This morning, the same court had ruled that five lawyers, including constitutional expert Tommy Thomas, had no locus standi to represent the Perak Speaker in court.
The judge said the Speaker must be represented by the state legal advisor because he is part of the state government.
Firoz and Hafarizam however, refused to comment on the letter sent to Ridwan earlier whereby Sivakumar stated that he had not authorised nor communicated with the state legal advisor on this case as it “was not given to us.”
Sivakumar was represented in this afternoon’s proceedings by Zulkarnain, who insisted that there was no conflict of interest, despite the fact that the state legal advisor is defending Zambry in the ongoing case in the Kuala Lumpur High Court, where the legality of his appointment as menteri besar is being questioned.
“We are looking after the interests of the government. Our duty as legal advisors is to advice the government,” he said.
However, he said that “I cannot recall” when pressed on who had raised the preliminary objection to the team of lawyers initially appointed by Sivakumar.
A statement by Thomas, who was the lead counsel for Sivakumar, had claimed that the complainant had raised the objection but it was supported by Zulkarnain.
A hearing date will be set by the court on March 5, which is also the day that the three independents who left Pakatan Rakyat and now support Barisan Nasional, will go to court to quash the speaker’s decision to consider their state assembly seats vacant.
Given today’s ruling, it is likely that Sivakumar will once again be represented by the state legal advisor.

The point is, did the judge (or in fact the UMNO goons' lawyers) EVER read the Perak Constitution? The Speaker can hold the assembly ANYWHERE - even under a tree.

The BN illegally denied the elected assemblymen into their state assembly building. The assemblymen had the proceedings somewhere else. Then the judicial rule that the sitting is illegal because it was held elsewhere.
In other words, in this country, the courts have a direct control on whether or not the elected officials are doing their job since the judicial, and not the speaker of the house, that determines if the sitting has taken place.
Maybe every state speaker in Malaysia would need to get 'permission' from the courts in order to hold a sitting. So where does that leave the Sultan?

However, there is only one course of action left and that is to keep up the flurry of legal actions up; eventually Parliament will have to meet, because there is a time window within which Parliament must meet (6 months); then that is another occassion when the issue of the powers of the Speaker will again come to the fore. However blatant the judges abuse their power in relation to this confrontation, there must come a time when the powers of the speaker will again become an issue, example, the Speaker's decision that the FROGS are deemed to be have resigned by their letters of resignation. The judge's order (rightly or wrongly made) I am sure will be to quash the speaker's decision that they have resigned, will still become issue when Parliament next sits;hence if the HOUSE RULES GIVES THE SPEAKER FINAL SAY ON ALL ISSUES BEFORE THE HOUSE THEN SPEAKER'S RULING WILL PREVAIL OVER THE JUDGE'S ORDER TO QUASH SPEAKERS' FINDING. Here again the issue of separation of powers will become the dominant issue and this will cause another round of legal suits flying. Tha way I look at this confrontation EVERYTHING GOES IN A CIRCLE "round and round and round; there is no end at all.
There reason why there is no end is because the Judges will not enforce the laws; and their partisanship keep the issues going in circle is because the judges abuse their powers in the courts, but their powers cannot extend into the Parliament; so what is done outside in the court room; is quickly UNDONE IN THE PARLIAMENT. There is only one solution and that is to declare EMERGENCY RULE and that will be fine EXCEPT THAT IN THIS CLIMATE OF ECONOMIC MELTDOWN, such a course must not be attempted even crazy as the government is. CAN WE IMAGINE INVESTORS AND BUYERS AND TOURIST WILL THINK OF MALAYSIA IN A STATE OF EMERGENCY !

I thought we must mark this third of March, a day of infamy.
There are, of course, those who do not want us to speak. I suspect even now orders are being shouted into telephones and men with guns will soon be on their way. Why? How did this happen? Who's to blame? Well certainly there are those who are more responsible than others, and they will be held accountable. But again, truth be told...if you're looking for the guilty, you need only look into a mirror.
So if you've seen nothing, if the crimes of this government remain unknown to you, then I would suggest that you allow the third of March to pass unmarked. But if you see what I see, if you feel as I feel, and if you would seek as I seek...then I ask you to stand beside me and be counted, at the next GE, at the ballet booth of power. 1. The meeting of the PR assembly men ended about 10.30 am. The court decision was only made at after noon after the meeting had ended. The judge specifically mentioned that it does not apply retrospectively. So how could the earlier meeting be illegal?
2. Can the judge's decision be valid if Sivakumar:
i. is unrepresented?
ii. his lawyer has committed a conflict of interest by representing both the accused and the plaintiff? This may be the first in the history of Malaysia and around the world where the presiding judge allows this!
3. How can the restraining order be indefinite as to time? Does that mean Sivakumar cannot hold another Perak assembly until the next General Election? Therefore the state assembly and all business activities, investment, etc in Perak are to be suspended until 2013 by virtue of the judge's order. Maybe the judge aspires to be the Sultan?
4. No penalty for breaching his RO? So why bother with the RO?
5. No grounds of decision backing his judgment?
6. So expeditious (taking only 2-3 hours in deciding his judgment) in such a very complex case? Is he superman or superficial?
7. Is the state assembly speaker within the jurisdiction of the courts such that he can issue an restraining order? A high court judge ordering a state assembly speaker what to do or not to do. A clerk in a construction company ordering a boss in a manufacturing company?
It is so pathetic in Malaysia that the higher you go in the hierarchy of the courts the worst are the quality of the judges and the bias of judgment. Many a time, the magistrate and session courts deliver better and more unbiased judgment. That is because all the judges that favour the powers that be have been promoted leaving only the good judges behind in the lower courts. That's why all opposition fear to bring their cases to higher courts because they will be stepping into kangaroo courts!

In other words, it does not apply to the Emergency Sitting held earlier in the morning and therefore the motions passed therein. Thus, The caption for this article - "Court Declares Assembly Illegal" - is incorrect.
The declaration was only a sop to Mr Zambry. He did not quite get what he wanted which was to stop TODAY's emergency sitting. He lost.

I just feel sorry for the people of Perak where we know who we voted for and yet we are governing by a bunch of crooks, thieves and robbers.
Who are this judge to decide who is right and who is not? Every one are bias and always favour only one side, and you know who!
In my opinion, we should have an international panel of judges to sit this hearing, to be fair to all parties.
Why bother having an election in the first place?

PR, please vet and pick your representatives carefully. You are here to serve and not to enrich yourself, or to dive brand new car. Regardless of your years of experience or you think you should be entire to high official post, and if you do not get those perks, so be it. Resign and get out if you are not happy.
If you intend to blackmail your own party to achieve your own aim, then you are worthless to those who voted you in. Remember that we can always forgive but we will never forget.
Long live democracy in Perak, if there is such a word. Shame on you UMNO, and you are not representing me. I only see you as just common thieves, nothing else.

Bila ADUN lompat (termasuk DUN yang rasuah/melacur) dan membentuk kerajaan TANPA sokongan rakyat, itu tidak memalukan??? Bodoh! Saya dahulunya penyokong kuat BN namun disebabkan Rasuah dan Salahguna kuasa oleh pemimpin BN terutama UMNO, saya rasa tindakan saya (termasuk majority Malaysia) untuk mengguling BN adalah wajar!

We can be worried about the global economy but you are dumb fool not to worry about the current political situation in Malaysia. It is time to get rid of this corrupted UMNO leaders. They are just making things worse. Corruption means less fund used to implement a project (More than half goes into their pocket). Corruption means the most able contractors do not get the project because the YB has awarded it to his machais. Corruption means there is NO quality at all to the product because fund has been slashed... and so on... SO AM I WORRIED ABOUT ECONOMY??? YES!!! The BN is still in power and they are making the economy worse!!!!!

Good evening, London. Allow me first to apologize for this interruption. I do, like many of you, appreciate the comforts of every day routine- the security of the familiar, the tranquility of repetition. I enjoy them as much as any bloke. But in the spirit of commemoration, thereby those important events of the past usually associated with someone's death or the end of some awful bloody struggle, a celebration of a nice holiday, I thought we could mark this November the 5th, a day that is sadly no longer remembered, by taking some time out of our daily lives to sit down and have a little chat. There are of course those who do not want us to speak. I suspect even now, orders are being shouted into telephones, and men with guns will soon be on their way. Why? Because while the truncheon may be used in lieu of conversation, words will always retain their power. Words offer the means to meaning, and for those who will listen, the enunciation of truth. And the truth is, there is something terribly wrong with this country, isn't there? Cruelty and injustice, intolerance and oppression. And where once you had the freedom to object, to think and speak as you saw fit, you now have censors and systems of surveillance coercing your conformity and soliciting your submission. How did this happen? Who's to blame? Well certainly there are those more responsible than others, and they will be held accountable, but again truth be told, if you're looking for the guilty, you need only look into a mirror. I know why you did it. I know you were afraid. Who wouldn't be? War, terror, disease. There were a myriad of problems which conspired to corrupt your reason and rob you of your common sense. Fear got the best of you, and in your panic you turned to the now high chancellor, Adam Sutler. He promised you order, he promised you peace, and all he demanded in return was your silent, obedient consent. Last night I sought to end that silence. Last night I destroyed the Old Bailey, to remind this country of what it has forgotten. More than four hundred years ago a great citizen wished to embed the fifth of November forever in our memory. His hope was to remind the world that fairness, justice, and freedom are more than words, they are perspectives. So if you've seen nothing, if the crimes of this government remain unknown to you then I would suggest you allow the fifth of November to pass unmarked. But if you see what I see, if you feel as I feel, and if you would seek as I seek, then I ask you to stand beside me one year from tonight, outside the gates of Parliament, and together we shall give them a fifth of November that shall never, ever be forgot.

Find out and the answers wiill come easily.
For this simple reason it may be possible that there is no way that PR can or will be allowed to take power by the highest authorities in the State.

I strongly believe that PR had reviewed all the Penal before calling for "Emergency Sitting". Really surprised that High Court declared this meeting as "Invalid"
Malaysia is no longer for Malaysian anymore, I think we should rename Malaysia => BN-UMNO
I'm sure PR will bring this issue to Federal Court. Let's call for fresh election to end this long pending issue. Perakians can't afford to live in such a situation anymore.
