KUALA LUMPUR, March 14 — More than a month after Barisan Nasional ousted Pakatan Rakyat from Perak, former Prime Minister Tun Dr Mahathir Mohamad today said the takeover was not done according to the law.
He said mistakes, bad strategy and carelessness in the Feb 5 power grab, orchestrated by Deputy Prime Minister Datuk Seri Najib Razak, had led to the current crisis in the state.
"You cannot topple a menteri besar or a prime minister without a no-confidence vote in the assembly. There is no other provision," he said at a function organised by Mubarak, the association for former elected representatives.
"Umno-BN was too careless and did not wait for an assembly but instead asked the Ruler to sack the menteri besar," he said, referring to Sultan Azlan Shah's decision to ask Datuk Seri Nizar Jamaluddin to resign.
"As far as I know, there is no such provision in the Perak or Federal Constitution," he said.
Dr Mahathir said that BN should have done it properly and not "be in conflict with the law" as the courts may now rule that the Sultan has no right to sack a menteri besar.
He added that a Sultan could only reject a candidate for one of his choice after an election but even this candidate could be defeated in the assembly by a vote.
The veteran politician said BN should have "followed the laws of the country, especially the constitution."
"Because this may be in conflict with the law, we find that people will not comply. Because we started on the wrong foot, people are now against us," said Dr Mahathir, who quit Umno last year in a long-running feud with his successor Datuk Seri Abdullah Ahmad Badawi.
The Perak power grab is now mired in a series of lawsuits, with both sides claiming to be the legitimate government.
Six people have also been charged with insulting the Perak Ruler after he backed BN to govern the state. One has pleaded guilty and was fined RM10,000 yesterday while five others claimed trial.
Umno has said those who opposed the Sultan's decision are committing treason.

Not Umno nor sultan is above the law - we know that too.
Umno says to go against the decision of the sultan is regarded as treason...
What if the sultan's decision is wrong on the side of the law and un-constitutional???
Is that still a treason to go agains the sultan's decision???

Mahathir says the court of law will deliberate since Nizar has filed a suit in the High Court against Zambry, and in that case the issue will arise on the decision of the sultan...
If Dr Mahathir is right, and we believe he is spot on -
and find the sultan's decision to sack a menteri besar is unconstitutional, then we really have a situation...Umno has given the sultan BAD ADVICE!!!
We all know that mb or pm can only be sacked if there is no-confidence vote...that was the request by Nizar when he advise the sultan to let the dewan decide...
The sultan should now take this whole issue back to the people.
Let the people vote!!!!
Why waste time and money with all these lawsuits and counter suits????

As far as bn govt is concerned, they would try as much as possible to fool the rakyat esp the Malays who watch the Bulletin or Berita Nasional.
I have already boycotted their news long long time ago since I know whatever news about our country's politics mostly are biased. No news about PR. Is this democratic?

This episode Tengku, tells the public that UMNO does not know how to lose. They are sore losers!
What is there to lose? UMNO has already lost. We have lost the Malay belt states. Kelantan- we shall never get it back in the foreseeable future. We are on the brink of losing Terengganu.
We must learn to lose gracefully and maintain self respect. The rakyat will respect us for that.

Tengku and Mahathir are the best two Prime Ministers Malaysia ever had. The former, kind and benevolent, was loved by the people and the latter, go-getter and authoritarian, was feared and at the same time respected by the people. But Mahathir has achieved far more for the country than Tengku had. Mahathir made some mistakes the major ones being sacking the judges and instituting sodomy charges against Anwar. After all he too is human.
Mahathir himself is a master strategist and he is no lawyer or economist. What the Sultans are now saying and doing vindicates his moves against them in the past in clipping their powers. His move to bail out state enterprises with state funds from folding up is something which the US, Europe and other major countries are adopting today. What can be a bigger tribute to him than this?
His distracters have been too unkind to him. He deserves his place in history

The Sovereign may choose, entirely on his own discretion, an MB from among the SA whom he thinks can command the confidence of the legislative assembly.
However, once appointed, the MB cannot be sacked by the Sultan.
The proper way is to defeat the MB with a vote of no confidence.

Dr M has done many rights and many wrongs in the past, but we must admit the man has balls. It is due to the fact he has balls, he has always acted on his own terms and won the people support in general election one after another to form the ruling government. He has even stood against the royal in 1993 to revoke the prosecution immunity from the rulers, after a series of scandals involving the ruler.
Unlike many hypocrites regardless where they are from and who they are, Dr M earns my fullest respect in terms of courage and speakout, way above many rulers especially the Perak sultan who used to be once the chief judge.
