KUALA LUMPUR, July 3 – The High Court here today acquitted a man of a charge of murdering his father by reason of insanity and ordered that he be detained at Hospital Bahagia, Hulu Kinta, Perak, at the pleasure of the Yang di-Pertuan Agong.
Justice Datuk Ghazali Cha, in his judgment, said that although the prosecution had established a case against Mohd Zin Ismail, the court ruled that when the murder was committed, he was of unsound mind and did not know the consequences of his act.
Mohd Zin, 41, was charged with murdering Ismail Talib, 79, at house No.115 Jalan Ikhlas, Bandar Tun Razak, between 2am and 3am on Nov 8, 2006.
The court heard Ismail, a government retiree, was sleeping when Mohd Zin, who was armed with a knife, entered the room and stabbed him on the abdomen and then slashed his neck.
Mohd Zin was arrested three hours later when he surrendered to the police.
Ghazali said the testimony of Dr Rabiah Mohd Salleh, from the Hulu Kinta Hospital, showed that at the time of the incident, Mohd Zin, who claimed to be hearing voices and seeing things, was suffering from a serious mental disorder.
The court ruled that Mohd Zin committed the offence with no criminal intent and therefore, acquitted him of the murder charge on grounds of insanity, he added.
Mohd Zin was represented by counsel Datuk Baljit Singh Sidhu, while deputy public prosecutor Ain-Nur Amiyyerra Abdullah prosecuted. – Bernama
