GEORGETOWN, Aug 8 – Penang Chief Minister Lim Guan Eng said today he would have no further meetings with the residents of Kampung Buah Pala after they rejected an offer of a double-storey terrace house for each family.
He said the demand by residents for compensation of RM3.5 million each instead of the double-storey house negotiated by the states was unacceptable.
“Perhaps the residents should ask around to see if Penangites would support their demand.
“We understand their predicament but there is only so much the government can do to help them,” he said today.
The Kampung Buah Pala issue has dogged Lim’s administration in recent weeks after the issue was turned into a racial dispute with Hindraf leaders accusing the state of helping to destroy what they claim was an Indian heritage area.
The controversy took a farcical turn with Hindraf recently saying it had made an appeal to Unesco to revoke Georgetown’s heritage city status for allowing Kampung Buah Pala – a settlement of cowherds – to be destroyed.
Kampong Buah Pala sits on former plantation land which the former colonial owners had given in trust to its former workers to live on when they left the state.
The British colonial government acted as trustees, but the land was signed away back to the state during independence, and the descendents of the original settlers had been allowed to stay on what had become temporary occupational license (TOL) land.
During the previous Barisan Nasional (BN) administration, the land was sold, and the current owners won a court decision recently to evict the villagers in order to develop high-rise apartments.
Lim said today that he believed the Penang public was angry at the latest development in the controversy since the villagers had rejected the offer from the developer.
“Don’t forget we’re trying to offer you a house.
“Now we even have people from Selangor speaking on behalf of the residents. Maybe they can fight for them and demand for a RM3.5mil house.
“Those outsiders, they have their own houses to go back to. Even some of the residents’ association members have other houses,” he said.
Commenting on the residents’ reasons for not accepting the offer, he explained that they appeared to be unhappy with a clause inserted in the proposed agreement which was meant to protect the rights of the developer.
The clause in question states that the agreement would be null and void if it could not obtain the state government’s approval to build the houses.
“If they want to build and the state government does not allow, they will then be sued by the residents.
“Do you think we will reject or revoke building plans for the 24 houses when we are the ones who found the formula to resolve the issue?” he said.

Just let them be after all they have financial backing from MIC whom are wiling to given them each RM139k cash from the total RM3.2 millions. I think they are more happy to hug with them the money in RM10 denomination rather then a double storey house.

If you think that the British colonial government has given you the ownership of the land, then show up your documentary evidence to lay your claim (presumably you are the righful descendent of the rightful owner).
If you feel that the vacant land you are staying in will be granted with heritage status by UNESCO, I would say you would not be. Please refer to the pre-requisite conditions for applying for heritage status from UNESCO. Do you cherish the so called historical aspect of the land ? So much so that you upkeep it properly to live up to its expectation.
If you seriously think that your case entitles you to a RM3.50 million (even half of it) compensation, I say right in front of you that you are a day dreamer. Or someone has said it to you then he is a liar.
I feel that if don't grasp the offer now you only have youerself to be blame.
You may say PR has promised you compensation up to your satisfaction ,but now it could not materialise the promise, you feel that you are being cheated. But how about BN government which has promised all Malaysians all the goodies for 52 years, yet how many of its promises have been materialised.
Last but not the least, personally I envy the offer of a double storey terrace house in Pneng inreturn for a wooden house in TOL.

From my observation over many years I must admit that the "compensation" offered by the developer must be the most generous ever offered to squatters. In most similar cases the squatters only get a low cost flat worth RM25,000. Here each one will get a house worth a few hundred thousand ringgit!!. Consider how lucky the Buah Pala residents are. If I were you I will quickly accept the offer before it lapses.

As the residence aren't willing to accept what the current state government has to offer, they are on their own. The state government is not obligated to compensate them in the first place.

To get a 2 storey house in such a prime area is like striking at least the Toto Jackpot first prize of RM300,000. Why go buy lotteries? I will also shift to Panange from KL and built a small shaty hut just next to the Esplanade to stay and within months, I will be offered similar compensations...wow....what an easy way to make money and maybe even have MCA or Gerakan Youth too help me in my cause too...and probably donate 5% of my compansatioans to them too....good investment plan right?
KBP residents, take the offer and start preparations to shift cuz if not you will be left with nothing and when the bulldozers come, its even worse as the police will be there to detain you should you try to fight back. I am speaking from experience.

The other option is to litigate till the cows come home at a heavy price in terms of time and money.

You get my support as you tried your best and had even bend all the way to accomodate the Kg. Buah Pala residents even at the expense of some of the Penangites who previously had been squatting on government TOL land and had to be evicted by the developer and BN without a cent of compensation.
From the events of the case, it is apparent that there are some invisible hands behind the whole issue out to discredit the PR government and in particular the MIC and Hindraf and the Penang UMNO racists.
They are out to confuse the villagers promising them heaven but retracted and keep quiet when the whole settlement falls apart.
The house value is worth RM 300,000 to RM500,000 and where on earth do one get such a windfall when the land is not in one's name.
I graduated from the local varsity in the sixties and had to struggle to save and earn every cent in order to get a decent house over my head and here the villagers are offered a reasonable compensation with the help of the PR state government and now they rejected it.
Everyone likes to have more but there is a limit to anything in life. I would love to have the RM 24 million Khir Toyol's house as well but the fact is can I afford it ?
Added to this, I wonder why Koh Tsu Koon is keeping so quiet ? Is it because after stirring the shit he expected the PR government to clean it for them.

Fact 1:-
According to our National Land Code (NLC), the legal proprietor of a piece of land is the person or body registered in the land registry. It has not been disputed that "Koperasi Pegawai Kerajaan Pulau Pinang Bhd" is still the registered proprietor of the Kampong Buah Pala land.
Fact 2 :-
Our courts have decided that "Koperasi Pegawai Kerajaan Pulau Pinang Bhd" is the rightful and legal proprietor of the Kampong Buah Pala land.
Fact 3 :-
At the time the Kampong Buah Pala land was alienated to Koperasi Pegawai Kerajaan Pulau Pinang Bhd, its status was state land.
Fact 4 :-
The Kampong Buah Pala villagers were not even TOL holders at the material time the land was alienated to Koperasi Pegawai Kerajaan Pulau Pinang Bhd. The villagers themselves had claimed that the land office refused to accept the annual TOL fees when they tried to make payment. This simply means that the villagers have been illegal squatters on state land.
Fact 5 :-
The Kampong Buah Pala land was legally alienated to Koperasi Pegawai Kerajaan Pulau Pinang Bhd. The then BN state authority using powers vested to it by the NLC and state land rules approved the application by Koperasi Pegawai Kerajaan Pulau Pinang Bhd for the state land. Koperasi Pegawai Kerajaan Pulau Pinang Bhd paid the required land premium and all other fees within the stipulated time. Subsequently the Registrar of Titles were legally bound to register and issue the land title to Koperasi Pegawai Kerajaan Pulau Pinang Bhd, and which they did.
Whether the alienation by the previous BN government was proper or not is a matter of opinion, and as someone had said, "opinion is like an arsehole, everyone has one". Until the courts decide otherwise, the fact remains that the alienation was legal. It serves no purpose for people like "yishan" and others with the same thinking to continue claiming that the alienation was fraudulent and therefore illegal. Your claims are absolutely irrelevant and carry absolutely no weight.
Fiction 1 :-
The Kampong Buah Pala land was fraudulently taken from the villagers and given to Koperasi Pegawai Kerajaan Pulau Pinang Bhd. The villagers were not legal registered proprietors but were squatters on state land at the time of it's alienation to Koperasi Pegawai Kerajaan Pulau Pinang Bhd. They cannot lose what was not theirs in the first place.
Fiction 2 :
Squatters are entitled to compensation. The practice of compensating evicted squatters has always been carried out on humanitarian and political considerations, and not because of legal requirement.
Now that we are over fact and fiction let me give my opinion. The parties to be blamed are the following:-
1. The ancestors of the present Kampong Buah Pala villagers for surrendering the trust land back to the state. I gather this so-called fact from various news reports and is not verified.
2. The previous state government for alienating the land to Koperasi Pegawai Kerajaan Pulau Pinang Bhd despite knowing that there was an existing village on the land. Their act may be legal but, in my opinion, improper.
3. Agent provocateurs, especially Hindraf, MIC and some unscrupulous lawyers with their own agenda for misleading the villagers.
Finally allow me to ask everyone a simple question, hypothetical to some and real-life to others:-
You own a piece of undeveloped land which are left unattended. One day you are horrified to discover a colony of squatters on it. You ask them to leave but they tell you that they will only leave with a amount of compensation which you find excessive and unwarranted. What will you do? Will you still think of the villagers as "the poor folks of Kg Buah Pala"?
People like "yishan" should get a grip of their emotions when making comments and giving opinions. Of course they first have to be able to distinguish fact from fiction.

a) 1999 or later, it should be for a Co-operative. A co-operative should mean for to solve the HOUSING problem of their members and not for a Commercial project for profit. KPKPPB is not a Co-operative!
b) In 2004, it was mentioned as NOT SUITABLE for Highrise. So, the alienation for Condo should be voided.
c) The alienation given to the "Co-operative" on August 8, 2005, required the "cooperative" to take care of the needs and welfare of the residents and the premium was to be RM6.4million.
d) The Premium started to be paid on January 2006. Meaning the "Cooperative" had agreed to the terms.
e) The offer from the Developer to the residents only come in in March 22, 2007.
e) The application and approval for discount on April 25, 2007 due to offers to residents is not valid due to point c) above.
f) the balance of Premium was paid on March 14, 2008 with the Title issued on March 27, 2008.
However, NLC Section 116 a) required building to be erected within two years from date of approval. Therefore, the alienation already expired in August 7, 2007. The offer to residence only on March 22, 2007 since its approval in August 8, 2005 had indicated that the Developer was not serious.
3. By all means, the alienation should be voided and the Land Title was issued on basis of a series of Fraudulent, and, an expired alienation. Therefore, the Title was not valid.
4. The claim that the Developer had sold the units are invalid as they need at least a Development Order to get Advertising and Sales Permit before they can sell the units.
5. The matter is clearly a scandal or conspiracy. The Alienation should by all means be lifted or voided.
6. Since the ancestors of the Residents were only given the Rights to stay and most probably not the ownership, their legal standi remains to be sorted out after sorting out the ownership of the land. Whether the Government is the Trustee is this case must be clarified or verified. NOTHING SHOULD PROCEED UNTIL THIS IS CLEAR. EXCEPT THE VOIDING OF THE ALIENATION!
