Lawyer ordered to enter defence on forged PA charge

KUALA LUMPUR, Oct 23 – A lawyer was ordered by the Sessions Court here today to enter his defence on three counts of using a forged power of attorney and giving false information in an affidavit relating to the sale of a piece of property in Bangsar.

Judge Rosenani Ab Rahman held that the prosecution had made out a prima facie case against S. Kanawagi, 64. She fixed Nov 24 and 25 to hear the defence.

Kanawagi is charged with two counts of using a forged power of attorney as genuine and registering it at the Kuala Lumpur High Court on Aug 7, 1993, and May 24, 1994.

He faces another charge of giving false information in an affidavit registered at the Kuala Lumpur Civil High Court on Feb 13, 1995.

He was represented by counsel Kamarul Hisham Kamaruddin while deputy public prosecutor S. Devananthan appeared for the prosecution.

Meanwhile, another Sessions Court judge, Rozana Ali Yusoff ordered a former BSN Commercial Bank officer, R.Arumugam, 59, to enter his defence on Oct 30 on a charge of receiving a RM5,000 bribe from Kanawagi.

Arumugam, a former police officer with the Bukit Aman Anti-Narcotics Division, is alleged to have received the bribe to refrain from taking action against Kanawagi over a police report regarding the same property in Bangsar.

The offence was allegedly committed in Jalan Abdullah off Jalan Bangsar about 6.30pm on March 9, 1999.

Arumugam was represented by counsel Gurbachan Singh while deputy public prosecutor Mohd Asnawi Abu Hanipah appeared for the Malaysian Anti-Corruption Commission (MACC). – Bernama
