Hishammuddin wants MCA to leave RoS out of crisis

KUALA LUMPUR, Oct 27 — The Registrar of Societies (RoS) on Friday decided not to be dragged in to the MCA impasse and asked the party’s central committee (CC) to find a suitable solution to the crisis.

Home Minister Datuk Seri Hishammuddin Hussein explained that the Registrar does not have the provision to decide on the matter as the Societies Act (1966) “is silent on issues of this nature.”

Hishammuddin added that he had received a letter from Datuk Seri Dr Chua Soi Lek yesterday, but did not disclose the contents.

Chua filed an application with the office of the RoS to be reinstated as the deputy president of MCA, after the CC appointed Datuk Seri Liow Tiong Lai to the same post.

In the application to the registrar, Chua argued that the Oct 10 EGM vote had effectively reinstated him as deputy president.

At the EGM, delegates had approved a resolution to annul the suspension of his membership in MCA.

However, a separate resolution to specifically reinstate him as deputy president was defeated.

But Chua is contending that the approval of the resolution to annul his suspension effectively meant a return to the status quo — that he should continue as MCA’s No. 2.

However, Hishammuddin pointed out that any party unsatisfied with an RoS verdict can appeal under Section 18 of the Societies Act.

“Anybody who is not satisfied with the RoS decision can make an application to the minister,” he told reporters during a press conference in parliament.

Hishammuddin said that he has to refer to the RoS and the ministry lawyer to determine if the letter was an appeal.

“I have received the letter, whether it is an explanation of what has happened or whether it is only additional information or if it is an appeal... I have to get an opinion from the ministry’s lawyer. But if it is an appeal then I have to make a final say of his position in the party,” he stressed.

He also reiterated his belief that MCA should find a solution to the crisis and not let the RoS be dragged into this matter.

“If there is a formula which has been announced recently to find a solution to the crisis in MCA then there is no need to bring the RoS into this matter because if they are really sincere in solving their problems then there is no need for a third party to get involved in this matter,” he said.
