KOTA BARU, Oct 27 – The Magistrate's Court here today overruled objections by the prosecution and allowed the defence to produce a video recording of the incident three years ago where former prime Tun Dr Mahathir Mohamad was showered with pepper spray.
Businessman Datuk Nik Sapeia Nik Yusoff is on trial in the court for allegedly hurting Dr Mahathir and three others with pepper spray in the incident.
Deputy Public Prosecutor Idham Abd Ghani had objected to the tendering of the recording by the defence's first witness, Ahmad Norzaki Mohd Noor, 40, a broadcast journalist with the NTV7 television station, on the grounds that the tape might have been tampered with.
However, magistrate Azman Mustafa overruled the objection and allowed it to be tendered as an exhibit by the defence.
Nik Sapeia, 54, who is represented by counsel Saseedharan Menon, Shamsul Bahrain Ibrahim, Zainal Abidin Mustaffa and Mohamad Ilyas Mohd Noor, was ordered by the court on July 28 to enter his defence after the prosecution succeeded in proving a prima facie case against him.
Nik Sapeia is charged with discharging a pepper spray and as result had caused injury to Dr Mahathir, Datuk Ibrahim Ali, Nasir Muda and Suberi Sahidan on July 28, 2006. He is alleged to have committed the offence at the Sultan Ismail Petra Airport in Pengkalan Chepa near here at 11am that day.
He has been charged under Section 324 of the Penal Code, which provides for jail up to three years or fine or whipping or any two of the punishment, if convicted. – Bernama
