KUALA LUMPUR, Nov 12 — After backing a Nov 28 EGM calling for fresh party polls, former MCA secretary-general Datuk Ong Ka Chuan stepped up his offensive today and blamed the leadership crisis on both president Datuk Seri Ong Tee Keat and his deputy Datuk Seri Dr Chua Soi Lek.
He said both should respect the outcome of an earlier Oct 10 extraordinary general meeting (EGM) and walk away from their posts after a majority voted against them.
"By not accepting the outcome of the EGM and then requesting the Registrar of Societies (RoS) to interfere is clearly a shortcut route taken by the top two leaders to avoid the EGM's decision," said Ka Chuan, who had lost to Dr Chua for the deputy presidency in last year's party elections.
"They have the moral obligation to adopt the resolutions that were passed at the Oct 10 EGM," he said, referring to the resolutions that rejected Tee Keat's stay in power and the reinstatement of Dr Chua as deputy president.
He accused Tee Keat of lack of transparency, claiming that the party's central committee members were kept in the dark about the unity plan he had forged with Dr Chua which led to the committee thinking that the deputy presidency post was vacant.
Under Article 174 of the MCA constitution, the central committee has the power to appoint a deputy should the post be vacant. It had appointed Datuk Seri Liow Tiong Lai after the Oct 10 EGM but it was later rescinded when Tee Keat tabled his "Greater Unity Plan".
"So we have a situation where we have two deputy presidents. I fear that this may lead to the situation similar to when Umno was declared illegal by the courts," said Ka Chuan.
Ka Chuan, who is Tapah MCA division chief, reiterated he is not supporting any camp but wants to see the party steer out of its current quagmire and return to its purpose — to serve the Chinese community.
"I think the decision to hold another EGM and hold fresh polls is a wise one," he said when asked by reporters if he was calling for the two top leaders to step down.
His views are similar to others who say they want unity in the party but the leadership would need a fresh mandate after the current crisis.
"I have no problem with unity and peace in the party. We all want that. But they are using the unity plan to cover up the intended consequences of the outcome of the EGM," Ka Chuan said.

His appointment is automatically null and void for not following procedure in a democratic party like MCA. If everyone starts to act like LTL with you as an advisor, the party would be in anarchy.

The Resolution 2 in the proposed illegal 2nd EGM which reads: "That all appointments, terminations or pledges made after the 10th Oct 2009 EGM by YB Dato Sri Ong Tee Keat in his capacity as President of the MCA be nullified".
Resolution 2 contravene with Article 166 which reads: Unless otherwise provided for in this Constitution, where powers are conferred on any person or body in this Constitution to appoint, such person or body shall also have the power to terminate such appointment in like manner.
Article 166 needs to be amended before Resolution 2 can be proposed in the AGM/AGM. Even if Resolution 2 is endorsed by the EGM it cannot be implemented as it is against Article 166.
Any action or resolutions to be passed by the AGM/EGM have to conform with the constitution of party before it could be applied. You need to amend the article in relation to the resolution proposed.
I have been dealing with ROS being actively involved in NGOs, and from my experience 2nd EGM is not costitutionally called. Just call off the EGM and work with the majority of the CCMs who have voiced and pledged to support the GUP for the unity of the party.

Initially said not neccessary to hold EGM because cost is high and waste money. Then when things swing around not in his favour, decide to call for EGM. Looking at the whole scenario, those at CC, holding minister post, appointed senator or etc are aiming at more on own benefits. Saying it is for party sake, is total bulshits.
Why not use normal exercise with facts and proof, if possible get signatures, OK.

Now that the 2 are willing to set a side their diferences and work together through GUP, the whole episode should end there. Afterall, the crises is between 2 individuals only. I don't understand why Brutus Liow and the gang are creating a fuss.

Thus during the 1st EGM, the outcome of the Resolution 1 did not vote out the President as Article 35 is crystal clear. Datuk Seri Ong Tee Keat is still constitutionally the President of the Party. I beg to differ from the view of Datuk Seri OKC the ex secretary general MCA who said that Datuk Seri OTK ceased to be President after the EGM.
I am very disappointed that he should be so naïve and unable to interpret such a simple and straight forward Article 35 of the constitution. Be sincere and conscientious when dealing with such a serious matter.
In Datuk Seri CLS’s case Datuk Seri Ong Ka Chuan tried to divert the blame to both CSL and OTK which is very irresponsible. As Datuk Seri CSL’s had clarified, he had already advised Datuk Sri LTL against the ploy to be appointed the Deputy President as he had written to the ROS for clarification pertaining to his post. Unfortunately, LTL and his cohorts were too impatient. At the same time, the ex legal bureau chairman also has much to be blamed as he had wrongly advised LTL regarding the matter. ROS is the governing body to all the legally registered societies in Malaysia including MCA, thus its directives or interpretation of the constitution are binding. Consequently, in the case of DS CSL, ROS stated that the Deputy President post has not been vacant after the 1st EGM thus again Datuk Seri Chua So Lek is the undisputed Deputy President. of the party.
I hope Datuk Seri Ong Ka Chuan would advise LTL and cohorts that being the minority they should work with the President who enjoys the majority support of the CCMs and not trying to champion for the indiscipline lost souls. The GUP was tabled by the President, deliberated at the CC meeting, accepted and sanctioned by at least 30 of the 43 CCMs. LTL and his cohorts being the principal office bearers are constitutionally bound to adopt and implement GUP. This is DEMOCRACY which he has been saying to uphold.
The party will not face deregistration if the party functions according to the constitution and always abide by the interpretation and directives of ROS. I have been dealing with ROS for decades being actively involved in NGOs and I am confident that by informing and getting clarification from ROS and abide by it will not land MCA in hot soup.

Most best way to solved is dissolved MCA now, re registred again by fresh election NOT BY delegates in MCA but chinese ppl at large..whole Malaysia.
All the post,Commitees,..etc must resigned. total clean up.Let the people vote who they trust.
if not..the `drama series will continue to 40 episode!!' spoiler for umno on BN..PM could be reject MCA from BN.
