Trader blinded by tear gas pellet awarded RM150,000 in damages

KOTA BARU, July 31 — A trader, who was blinded in his right eye after being hit by a tear gas pellet during a riot outside the Sultan Muhammad IV Stadium in 2009, was awarded RM150,000 in damages by the High Court here today.

The stadium was the venue for a football match between Kelantan and Negeri Sembilan.

Judge Datuk Ahmad Zaidi Ibrahim concluded that the plaintiff, Muhammad Huzaifah Muhd Noor, 22, had proven that the injury to his eye was the result of tear gas shots fired by the defendants in the suit who were Federal Reserve Unit officer ASP M.Sathasivam, the police and the Government of Malaysia.    

Ahmad Zaidi allowed RM20,000 in costs but did not grant the RM10 million in aggravated and exemplary damages sought by the plaintiff as he had failed to prove that the defendants were negligent and malicious.

Muhammad Huzaifah was represented by Marwaliz Mahmud while Federal Counsel Rohaiza Zainal appeared for the defendants. — Bernama
